Sexual Orientation Discrimination

While there is no federal law governing this type of discrimination, California’s Fair Employment and Housing Act (FEHA) prohibits an employer from discriminating against an employee or applicant based his or her sexual orientation. The discrimination is also illegal if it is based on a perceived sexual orientation.

Examples of Sexual Orientation Discrimination

  • Your employer fires you because of your sexual orientation, or your perceived sexual orientation
  • Your employer assigns you inferior duties because of your sexual orientation, or your perceived sexual orientation
  • You are paid less than a coworker who has the same job responsibilities and resume, and the only difference is your sexual orientation, or your perceived sexual orientation
  • You are not hired by an employer because of your sexual orientation, or your perceived sexual orientation

Helpful Tip:

Document The Behavior

To help prove your case, it is important you document the discrimination (i.e save emails, memos, text messages, etc) and that you follow the reporting system within your company to report the illegal conduct.  Of course there will be times when this is not possible, but remember the more evidence you have, the more it will help your case!
